Terms of Service

Welcome to Pawkins! These Terms of Service ("Terms") govern your use of the Pawkins mobile application (the "App") provided by Pawkins ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes on any Apple device that you own or control, subject to these Terms and the App Store Terms of Service.

You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer, decompile, or disassemble the App
  • Rent, lease, lend, sell, or sublicense the App
  • Use the App for any commercial purposes without our written consent
  • Remove or alter any proprietary notices or labels on the App

2. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to any portion of the App
  • Use the App to transmit any malware, viruses, or harmful code
  • Interfere with or disrupt the integrity or performance of the App
  • Attempt to exploit any bugs or vulnerabilities in the App

3. In-App Purchases

The App may offer in-app purchases. All purchases are processed by Apple through the App Store and are subject to Apple's terms and conditions.

  • Payment: All payment processing is handled by Apple. We do not collect or store any payment information.
  • Refunds: Refund requests must be made directly to Apple through their standard refund process. We cannot process refunds directly.
  • Pricing: Prices are displayed in your local currency and may vary by region. We reserve the right to change prices at any time.

4. Intellectual Property

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, pixel art, animations, and the design, selection, and arrangement thereof) are owned by Pawkins, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

5. User Content and Data

All data you create within the App (including your virtual pet's status and progress) is stored locally on your device. You are responsible for maintaining backups of your device. We are not responsible for any loss of data due to device failure, app deletion, or any other reason.

6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any errors in the App will be corrected.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAWKINS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the App
  • Any conduct or content of any third party related to the App
  • Unauthorized access, use, or alteration of your data
  • Any bugs, viruses, or other harmful code transmitted through the App

8. Indemnification

You agree to defend, indemnify, and hold harmless Pawkins and its affiliates, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms or your use of the App.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms within the App or on our website and updating the "Last Updated" date. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the App will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pawkins operates, without regard to its conflict of law provisions.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pawkins regarding the use of the App and supersede all prior agreements and understandings.
